Terms of Service
1. Terms
By accessing any product or service offered by Seymour (such as the mobile application and website) (System), you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms of service, you are prohibited from using or accessing the System. These terms of service should be read in conjunction with the privacy policy
Seymour reserves the right, at any time, to update and change any or all of these terms of service, at its sole discretion, including but not limited to the fees and charges associated with the use of the System. If Seymour does so, Seymour will post the modified terms of service on its System, and you will be notified of any changes that, in Seymour’s sole discretion, materially impact these terms of service. Continued use of the System after any changes have been made will constitute your consent to such changes.
You are responsible for regularly reviewing the most current version of these terms of service.
2. Privacy Policy
Seymour collects personal information necessary to deliver the services of the system. The system will collect your personal information on your behalf for the purpose of facilitation of the system's services. Please find the privacy policy here.
This personal information is submitted originally by you at your full permission either directly to the system or by a booking agent and includes but is not limited to: full name, address, email address, telephone numbers, country of origin, demographic, interest or preference information, passport, insurance and travel medical information, comments that you provide us and payment information which is required for the system to facilitate it’s services.
How this information is used:
We collect this information to provide you with the service of the system and communications regarding system products/purchases, confirmed or declined bookings and respond to your enquiries or requests either by the system or email. Your information is stored on secure databases at secure addresses and protected from unauthorised access. You have the right to request to be removed from all databases at any time. Please email help@seymour.travel to be removed or select delete my data within the system application.
We do not sell information that you have submitted to us to any third party.
If you are travelling on a product which includes transport operated by one of our partners we may supply them with your first and last name to confirm your spot. We will not share any contact details e.g. email address or phone number.
How card payment information is protected: Payment information is collected via the secure Payment Express gateway and is subject to Windcaves privacy policy.
Right to Data Deletion: "As outlined in our Privacy Policy, users have the right to request the deletion of their personal data collected through the System. If you wish to delete your data, you may do so by selecting the 'Delete My Data' option within the System application or by contacting us directly at help@seymour.travel. Please note that deleting your data may impact the availability of certain services within the System, and we will inform you if any services are affected."
Data Collection and Remarketing: Seymour collects data through trusted analytics tools such as Google Analytics, Google Tag Manager, and Firebase to better understand how our users interact with the System and to improve user experience. While Seymour does not use this data for remarketing purposes, please be aware that third-party services like Google Analytics may collect data through advertising cookies, which Google might use for remarketing in accordance with their own policies. If you wish to opt out of such practices, you can do so by installing the Google Analytics Opt-out Browser Add-on or refer to our Privacy Policy for further instructions. 3. User License
Permission is granted to use the System for personal, transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
Modify or copy the materials on the System;
Attempt to decompile or reverse engineer any software contained on the System;
Remove any copyright or other proprietary notations from the materials on the System; or
Transfer the materials on the System to another person or "mirror" the materials on any other server.
This license will automatically terminate if you violate any of these restrictions and may be terminated by Seymour at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials from the System in your possession whether in electronic or printed format and uninstall the System from any of your devices.
4. Your Obligations
You must provide true, current and complete information in your dealings with Seymour (including when setting up an account on the System) and must promptly update that information as required so that the information remains true, current and complete.
You must:
Not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the System, or otherwise attempt to damage or interfere with the System;
Not impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity, including Seymour;
Not post, upload, distribute, store, create or publish through the System any message, data, information, text, music, sound, photos, graphics, code or any other material that is false, unlawful, misleading, libellous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, or advocates harassment of another person, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable; and
Unless with Seymour written agreement, access the System via an applicable device. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.
You agree to indemnify Seymour and any of our officers, directors, employees, and agents from and against all claims, causes of action, demands, recoveries, fines, penalties and Loss that Seymour suffer or incur as a direct or indirect result of your failure to comply with these terms of service, including any failure of a person who accesses and uses the System by using the log in details supplied to you by Seymour.
5. Liability Disclaimer
The materials on the System are provided on an "as is" basis. Seymour, Stray Limited, and G Adventures make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violations of rights.
As a user of Seymour, you understand and agree that:
Neither Seymour, Stray Limited, G Adventures, nor their affiliates will have any liability to you or others for any unauthorised transactions made using your password or account.
The unauthorised use of your password or account could cause you to incur liability to Seymour, Stray Limited, G Adventures, and other users.
If you find that unauthorised transactions have been made on your account, please contact Seymour immediately at help@seymour.travel.
When you book a service or optional excursion via the System:
The System will collect your reservation information and transmit it to the Supplier to complete the transaction, as prescribed in the Seymour privacy policy.
Seymour fulfills your reservation and supplies the relevant goods or services via third-party Suppliers. Seymour, Stray Limited, and G Adventures expressly disclaim responsibility or liability for the organisation, operation, or safety of these third-party activities or excursions.
By making a booking, you unequivocally agree that all optional excursions or activities are provided and operated by independent third-party Suppliers and that Seymour, Stray Limited, and G Adventures are not liable for any acts, errors, omissions, representations, warranties, breaches, or negligence of these Suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting from your participation in such activities.
Supplier Independence
Seymour is not a travel agency and does not itself provide or own travel services or accommodations. Although Seymour as a platform enables you to book services via Suppliers, this does not imply, suggest, or constitute an approval, endorsement, or affiliation between Seymour, Stray Limited, G Adventures, and Suppliers.
The Suppliers providing services available through the System are independent businesses and not agents, contractors, or employees of Seymour, Stray Limited, or G Adventures. These Suppliers bear sole responsibility for their operations. By booking a service, you agree to review and be bound by the Supplier's terms and conditions, privacy policy, and other rules or policies related to their services. Seymour, Stray Limited, and G Adventures accept no liability for:
Acts, omissions, errors, representations, warranties, breaches, or negligence of any Supplier;
Personal injuries, death, property damage, or other damages or expenses resulting from interactions with Suppliers; or
Additional expenses or consequences resulting from strikes, force majeure events, government acts, or other causes beyond our direct control.
Limitation of Liability
To the maximum extent permitted by law, Seymour, Stray Limited, G Adventures, and their licensors are not liable for any Loss suffered in connection with:
The System being unavailable (in whole or in part) or performing slowly;
Any errors or omissions in information made available through the System;
Exposure to viruses or other forms of interference that may damage your system or expose you to fraud when accessing or using the System;
Visiting or using any linked third-party site or service.
For clarity, neither Seymour, Stray Limited, nor G Adventures warrants the safety, reliability, or suitability of any travel services or destinations listed on the System, nor do they assume liability for damages or losses incurred while participating in travel or activities booked through the System.
By using the System, you expressly acknowledge and agree to these terms.
6. Cancellations and Disputes
In order to obtain a refund on cancellation of a Booking, notice must be given to Seymour before the applicable deadline described in the cancellation policy of each Supplier displayed when you make the Booking (Supplier Deadline). On receipt of notice of a cancellation, refunds will be made as follows:
If notice is received before the applicable Supplier Deadline, 100% refund; and
If notice is received on or after the applicable Supplier Deadline, no refund.
If an issue arises between you and the Supplier please immediately contact Seymour at help@seymour.travel. You must disclose all relevant details of the issue so Seymour can investigate the issue on your behalf. In certain circumstances, Seymour may decide, at its sole discretion, that it is necessary to cancel a Booking and/or make appropriate reimbursement. This may be where Seymour believes in good faith, while taking the legitimate interests of both parties into account, this is necessary to avoid significant harm (whether reputational or otherwise) to Seymour, other travellers, Clients, third parties or property. Seymour will try to gather as much information from you and the Supplier concerning the dispute, the final decision will be made by Seymour.
7. Content on the System
When agreeing to be supplied a service by a Supplier, you will also be required to agree and adhere to terms and conditions of that Supplier.
The materials appearing on, or accessed via, the System could include technical, typographical, or photographic errors. Seymour does not warrant that any of the materials on, or accessed via, the System are accurate, complete or current. You agree that Seymour has no responsibility or liability for any materials accessed on a third party platform via the System.
Seymour may delete, or make changes to, the materials on the System at any time without notice. However, Seymour does not make any commitment to remove, update or correct such materials.
8. Limitations
In no event will Seymour be liable for any Loss arising out of the use or inability to use the materials on, or accessed via, the System, even if a Seymour authorized representative has been notified orally or in writing of the possibility of such damage.
To the maximum extent permitted by law:
You access and use the System at your own risk; and
We are not liable or responsible to you or any other person for any Loss under or in connection with these terms of service, the System, or your access and use of (or inability to access or use) the System. This exclusion applies regardless of whether our liability or responsibility arises in contract, tort (including negligence), equity, breach of statutory duty, or otherwise.
9. Suspension and Termination
Without prejudice to any other right or remedy available to Seymour or if, Seymour considers that you have breached these terms of service or Seymour otherwise considers it appropriate (at its absolute discretion), Seymour may immediately, and without notice, suspend or terminate your access to the System (or any part of it).
Seymour may at any time by written notice to you immediately terminate these terms of service and stop your access to the System.
On suspension or termination, you must immediately cease using the System and must not attempt to gain further access.
10. General
If Seymour needs to contact you, Seymour may do so by email or by posting a notice on the System. You agree that this satisfies all legal requirements in relation to written communications.
These terms of service, and any dispute relating to these terms of service or the System, are governed by and must be interpreted in accordance with the laws of New Zealand. Each party submits to the exclusive jurisdiction of the Courts of New Zealand, in relation to any dispute connected with these terms of service or the System.
For us to waive a right under these terms of service, the waiver must be in writing.
Clauses which, by their nature, are intended to survive termination of these terms of service continue in force.
If any part or provision of these terms of service is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as severed from these terms of service. The remainder of these terms of service will be binding on you.
These terms of service set out everything agreed by the parties relating to your use of the System and supersede and cancel anything discussed, exchanged or agreed prior to you agreeing to these terms of service. You acknowledge you have not relied on any representation, warranty or agreement relating to the System that is not expressly set out in the terms of service, and no such representation, warranty or agreement has any effect from the date you agreed to these terms of service.
11. Defined Terms
Unless the context otherwise requires, in these terms of service:
Loss includes loss of profits, loss of business, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis.
Supplier means a company that provides services such as activities, accommodation and food or beverage to you.
System means the platform or application used to make, amend, cancel, research or consume supplier products within the application.
The Seymour platform is owned and distributed by Stray Limited, a New Zealand registered company (NZBN: 9429037088415)
